Terms for businesses
Effective 2026-10-15
These terms govern the use of byrzo by the businesses that sell through it. By using byrzo and opening or connecting a Stripe account you accept them on the business's behalf.
1. Who we are
byrzo is provided by AR EM DIGITAL Ltd. („АР ЕМ ДИДЖИТАЛ" ООД), a limited liability company registered in Bulgaria, UIC 208452504. Contact us at support@qorder.me.
2. What byrzo provides
- A digital menu with extras, allergens and photos, opened from a link or a QR code.
- Prepaid orders collected at the business, with an Orders screen for the team.
- Card, Apple Pay and Google Pay payments through Stripe, into the business's own account.
- Emails to customers about their order, a monthly statement, and a file of the orders for the accounts.
We may add and change features; we'll give notice of significant changes.
3. Account
The business's account is created by byrzo. The owner adds the team and is responsible for accurate details, keeping passwords safe, and what the owner and the team do through the account. For support, a member of byrzo's staff may sign in to the account as the owner for up to an hour; every such sign-in is recorded.
4. byrzo's fee
€0.25 per paid order. No monthly fee, sign-up fee or minimum turnover.
- Stripe deducts the fee automatically as the platform's fee when you accept the order and the customer's card is charged. The rest stays in your Stripe account.
- No fee is taken for an order you reject, one cancelled because it wasn't accepted in time (see §6), one whose payment fails, or one of €0.25 or less.
- When you cancel an accepted order in byrzo while it's in "Preparing" or "Ready for pickup" (before it's marked collected or closed automatically), the customer gets the full amount back and byrzo's fee returns to your account. If you had already refunded the full amount in Stripe, byrzo's fee isn't returned; if you had refunded part of it there, only the matching part of the fee is returned.
- Stripe's own processing fees are separate and owed to Stripe under your agreement with it. Stripe deducts them from every payment at its own prices; on a refund, Stripe doesn't return its fee.
- Each month's fees are shown in "Statement" in byrzo. byrzo issues an invoice for them every calendar month.
- We announce a change to the fee by email at least 30 days ahead. If you don't agree, you can stop using byrzo before it takes effect.
5. Payments from customers
- The business opens its own Stripe account through byrzo and accepts Stripe's Connected Account Agreement. byrzo opens the account with the details it has for the business: the company name, legal form, UIC, registered address, VAT number, phone, kind of place, the name on bank statements and the owner's email. The business gives its ID, bank account and the details of the company's people straight to Stripe.
- Payments are made in the business's account: the business is the seller, and Stripe pays out to its bank account on Stripe's schedule. byrzo doesn't hold the business's money — it receives only its fee.
- Disputes (chargebacks) and refunds belong to the business's Stripe account. Cancel accepted orders in byrzo while they're in "Preparing" or "Ready for pickup": the customer is refunded and byrzo's fee comes back. An order marked collected or closed automatically (see §6) can't be cancelled in byrzo; any refund for it is made only in Stripe, and byrzo's fee isn't returned.
- If the business disconnects byrzo from its Stripe account, it can't take orders until the link is restored or a new account is opened. Before you disconnect, accept or reject new orders (including those in "For later"), and mark accepted ones collected or cancel them: once disconnected, byrzo has no access to your account and can't charge, release or refund their payments.
- Tips. If you turn them on in "Payments", customers can add a tip to their order. It's part of the payment into your Stripe account and entirely yours: byrzo takes no cut of it and byrzo's fee doesn't change. Stripe charges its fee on the whole payment. A tip is refunded to the customer together with the order.
6. Orders
- You accept or reject every new order. An order for as soon as possible that isn't accepted within 10 minutes is cancelled automatically.
- Orders for later. If you turn them on in "Opening hours", the customer picks a collection time (every 15 minutes, up to 8 hours ahead and no later than your closing in the current opening hours) and pays when ordering; the amount is only held on their card, sometimes for several hours. Such an order waits in "For later", where you can reject it. It moves into "New" 10 minutes before the kitchen has to start it (the chosen time minus your prep time). If you don't accept it within those 10 minutes, that is, by the time the kitchen has to start it, it's cancelled automatically.
- When an order is rejected or cancelled automatically, the held amount is released and no fee is taken.
- By accepting you commit to preparing the order and handing it to the customer at the stated time — for an order for later, the time the customer chose — or as close to it as you can.
- Stopping after a missed order. If an order you had the full 10 minutes for isn't accepted in time, and during those 10 minutes nobody on your team did any of the following in "Orders": accept, reject or cancel an order, mark one "Ready" or "Collected", or use "Stop orders" or "Busy", then byrzo automatically stops new orders for the business. Just having the screen open, "+5 min" or marking dishes sold out doesn't count. Orders start again when someone on your team taps "Take orders again", or by themselves when you next open according to your opening hours (if you're open round the clock, at 05:00). While they're stopped, customers see that you're not taking orders at the moment. Orders already placed aren't affected, and a customer who had already started paying before the stop can still finish; accept or reject that order as usual.
- Closing automatically. byrzo automatically closes an order that's ready, or accepted and past its promised time, that nobody marked as collected, once it has waited at least 30 minutes and the business has been closed for at least 30 minutes, and in any case once it has waited 12 hours. The payment doesn't change: the amount stays charged and byrzo's fee stays taken.
- You're responsible for the menu, prices (in euros, including VAT), availability and allergen information being accurate and current.
7. Receipts and tax
byrzo is a software platform. It is not a fiscal device, not sales-management software on НАП's list (СУПТО), and doesn't issue fiscal receipts. The business is fully responsible for issuing receipts and for its obligations under Ordinance N-18 and tax law for sales made through byrzo. A business that uses СУПТО tells us before it takes orders through byrzo.
The same goes for tips: the business decides how to share them and is responsible for booking them and for their tax treatment. byrzo shows them separately on the order, in "Statement" and in the CSV file.
8. Responsibility to customers
The business is the seller: it's responsible for the food, its quality and safety, allergen information and complaints, and for its legal obligations to consumers. Keep the business's details — legal entity and UIC, registered office, pickup address, phone and email — filled in and accurate, since customers see them on the menu and the order before they pay. We may pass customer questions and complaints on to the business.
9. Personal data
byrzo processes customers' and your team's data under the privacy policy. Use the order data you see only to fulfil the orders and meet your legal obligations.
10. Acceptable use
By using byrzo you agree not to:
- break food safety, alcohol, VAT or other hospitality rules;
- accept orders you can't or don't intend to fulfil;
- sell illegal or prohibited goods;
- misrepresent the business or its menu — name, address, prices, allergens;
- act for another business without its consent;
- try to gain unauthorised access to byrzo or overload it.
11. Intellectual property
byrzo — the software, design, logo and brand — belongs to its provider. You get a non-exclusive, non-transferable right to use it for your business while you use the service. The menu, photos and business details stay yours; you allow us to store and show them only to provide byrzo.
12. Ending the service
You can stop using byrzo at any time by writing to support@qorder.me or disconnecting byrzo from your Stripe account. Fees for orders charged and not cancelled in byrzo aren't refunded. We may suspend or limit access if these terms or the law are broken, or if Stripe stops serving the account. byrzo also stops new orders automatically after a missed order, as described in §6.
13. Limitation of liability
We make reasonable efforts to keep byrzo reliable but don't guarantee uninterrupted availability. We're not liable for lost profits from temporary unavailability, for third parties such as Stripe, or for disputes between the business and its customers. As far as the law allows, our total liability is limited to the fees byrzo collected in the previous 12 months.
14. Changes, law and disputes
We'll email at least 30 days before significant changes to these terms; continuing to use byrzo afterwards means you accept them. Bulgarian law applies; disputes go to the competent Bulgarian court at the provider's registered seat.
